By accessing or using CryptoWise FX's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services. These terms apply to all users of the platform, including browsers, vendors, customers, and contributors of content.

2. Description of Services

CryptoWise FX provides cryptocurrency investment management services, including:

Automated cryptocurrency portfolio management
AI-powered investment strategies
Real-time market analysis and reporting
Secure digital asset custody
Investment advisory services
Educational resources and market insights

3. Eligibility and Account Registration

3.1 Eligibility Requirements

To use our services, you must:

Be at least 18 years of age
Have legal capacity to enter into binding agreements
Reside in a jurisdiction where our services are legally available
Complete our KYC (Know Your Customer) verification process
Provide accurate and complete information during registration

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

4. Investment Risks and Disclaimers

4.1 Market Risks

Cryptocurrency markets are highly volatile and unpredictable
Values can fluctuate dramatically within short periods
Market conditions can change rapidly due to regulatory, technological, or economic factors
Liquidity may be limited for certain cryptocurrencies

4.2 Technology Risks

Blockchain networks may experience technical issues or attacks
Smart contracts may contain bugs or vulnerabilities
Network congestion may delay transactions
Hard forks may create uncertainty and volatility

4.3 Regulatory Risks

Cryptocurrency regulations may change without notice
Government actions may restrict or prohibit cryptocurrency activities
Tax treatment of cryptocurrencies may be uncertain or change
Compliance requirements may increase costs or limit services

5. Fees and Charges

Our fee structure is transparent and competitive. Current fees include:

Management fees: 1.5% - 2.5% annually based on portfolio type
Performance fees: 20% of profits above benchmark (Elite Portfolio only)
Deposit fees: Free for bank transfers, 2.5% for credit/debit cards
Withdrawal fees: $25 for bank transfers, network fees for crypto withdrawals
Inactivity fee: $50 per month after 12 months of inactivity

We reserve the right to modify our fee structure with 30 days' notice. Current fees are always available in your account dashboard.

6. Prohibited Activities

You agree not to:

Use our services for any illegal or unauthorized purpose
Engage in money laundering, terrorist financing, or other criminal activities
Manipulate markets or engage in fraudulent trading practices
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with or disrupt our services or servers
Provide false or misleading information during registration or KYC
Use our services if you are located in a restricted jurisdiction
Transfer your account to another person without our consent

7. Intellectual Property

All content, features, and functionality of our platform, including but not limited to text, graphics, logos, images, software, and algorithms, are owned by CryptoWise FX and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, CryptoWise FX shall not be liable for:

Any investment losses or damages resulting from market volatility
Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages resulting from third-party actions or system failures
Damages exceeding the fees paid to us in the 12 months preceding the claim

9. Indemnification

You agree to indemnify and hold harmless CryptoWise FX, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

10. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account immediately if you violate these terms or engage in prohibited activities. Upon termination:

Your access to our services will be immediately revoked
We will liquidate your positions and return funds (minus applicable fees)
You remain liable for any outstanding obligations
Provisions regarding liability, indemnification, and dispute resolution survive termination

11. Governing Law and Dispute Resolution

These terms are governed by the laws of New York, United States. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits or class-wide arbitration.

12. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or platform notification at least 30 days in advance. Your continued use of our services after changes take effect constitutes acceptance of the new terms.
